本稿では，国際人権としばしば鋭く対立するイスラームにおけるジェンダーに焦点をあてて，国際人権の何がイスラームの価値規範に抵触するとみなされているのか，ムスリム諸国が起草した人権宣言においてジェンダーはどのように規定されているのか，ムスリム諸国の法においてジェンダーはどのように規定されているのか，そしてかかるジェンダー観の根底にはいかなる思想があるのかを論じた．
イスラーム法は，男女の権利義務関係について，国際人権スタンダードとは異なる定めをしており，それを体現するのが，イスラーム協力機構が採択したカイロ人権宣言である．同人権宣言においては，男女の形式的平等は否定されている．かかる男女の形式的平等の否定は，イスラーム法に基づくものと解釈されており，かような男女の形式的平等の否定が端的に表れる場面が家族法領域である．これまでイスラーム法におけるジェンダーの問題は家族法の問題として議論が展開されてきたが，「アラブの春」後，例えばエジプト及びチュニジアでは，まさに公領域におけるジェンダーをめぐって激しい議論が繰り広げられている．今後，国際人権とイスラームにおけるジェンダーという課題については，とりわけ「アラブの春」後のムスリム諸国における家族法だけでなく憲法の動向も注視する必要があろう．

This article explores the following questions related to gender relations in Islamic law: What kinds of rights under international human rights standards are regarded as ones incompatible with Islamic law?; How do the International Islamic Declaration of Human Rights and The Cairo Declaration on Human Rights in Islam articulate gender issues?; How do Muslim-majority countries articulate gender issues?; and How is such a gender view justified?
As The Cairo Declaration on Human Rights in Islam shows, gender equality under international human rights standards is regarded as incompatible with Islamic law, in which there is no acceptance of formal equality between men and women grounded in Islamic law. Nowadays, such views on gender issues under Islamic law are articulated in the statutes of Islamic family law, and therefore, literature on gender issues in Islamic law have mainly discussed family law. However, it should be noted that gender issues in the so-called public sphere including the constitution have been highly disputed after the ‘Arab Spring’, as witnessed in Egypt and Tunisia.
