本稿の目的は，「外国につながる子ども」の学習権の保障に課題があることを明らかにすることである。このために，「外国につながる子ども」という認識で事態を捉える必要性を論ずる。これを踏まえ，「外国につながる子ども」が学習をしていくための政策や制度を批判的に検討し，これらが存在はするものの，彼／彼女らの学習権が実質的に保障されていない実態――本稿はこれを「置き去り」という認識で把握する――が，「五つの壁」で構造的に引き起こされていることを論じた。「外国につながる子ども」の学習する権利保障は，様々な背景を持つ人々とともに，彼／彼女らの基本的人権が保障される多文化共生社会を構築していくという課題への重要な取り組みである。

This paper asserts that there are problems ensuring that, like all children, foreign children in Japan have the right to learn. It discusses the urgency surrounding the recognition of “Culturally Linguistically Diverse Children” and critically examines the systems and policies regarding their right to learn. Although these children surely exist, their learning rights are not substantially guaranteed. This fact is represented here by the phrase “left behind”. The paper argues that this state of being “left behind” is structurally caused by “five walls” or obstacles. And finally, ensuring the right to learn for “Culturally Linguistically Diverse Children” is important for the following two reasons: A multicultural society must be built with people from various ethnic and linguistic backgrounds and the basic human rights of these people must be guaranteed.
